1. General

1.1 These General Terms and Conditions of AF ZFB GmbH, Rückerstraße 4, 10119 Berlin, hereinafter referred to as ‘Zeit für Brot’, ‘we’ or “us”, apply to the purchase of a voucher via the Zeit für Brot website, which can be accessed at the domain vexohorce.com (‘ZfB website’).

1.2 A gift voucher entitles its holder to claim services from the Zeit für Brot range of bakery branches to the value of the voucher amount upon presentation of the Zeit für Brot gift voucher. We issue the gift voucher electronically and send it to the email address you provide when purchasing the gift voucher via the ZfB website.

1.3 We publish the current version of these General Terms and Conditions on the ZfB website. They can be saved and printed out. Only the version of these General Terms and Conditions valid at the time of your voucher purchase is binding for your purchase of a voucher. Conflicting or deviating general terms and conditions shall only apply if Zeit für Brot has agreed to them in writing.

2. Purchase of a gift voucher

2.1 You must be at least eighteen years old to purchase a gift voucher.

2.2 When purchasing a gift voucher, you can choose from the gift voucher amounts offered and add the desired gift voucher to your shopping basket. At the end of the order process, the entire order, including delivery time and all costs, will be summarised once again. By clicking on the ‘Pay’ button, you are making a binding offer to conclude a voucher purchase contract with us. You will receive an email (order confirmation) about this. The purchase contract is concluded when you receive an email from us accepting your offer to conclude the contract (confirmation of contract conclusion).

2.3 If there is reason to believe that the purchase of the voucher involves fraud against Zeit für Brot or a third party, Zeit für Brot is entitled to withdraw from a purchase contract that has already been concluded. Such a case may arise, for example, if third-party personal data is provided for the purpose of deception or obtaining advantages by fraudulent means.

2.4 When purchasing goods in our bakery branches using the voucher, the holder of the voucher concludes a separate contract to which these General Terms and Conditions do not apply.

3. Right of withdrawal

Consumers have a statutory right of withdrawal when purchasing a gift voucher via the ZfB website. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.

Cancellation policy

Right of cancellation

You have the right to cancel this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you received the gift voucher.

To exercise your right of cancellation, you must inform us (AFB ZFB GmbH, Rückerstraße 4, 10119 Berlin, email: [email protected], telephone: +49 3028874286) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or email). You can use the attached sample withdrawal form for this purpose, but this is not mandatory.

To comply with the withdrawal period, it is sufficient that you send the notification of your exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of withdrawal

If you withdraw from this contract, Zeit für Brot shall reimburse you for all payments it has received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we receive notification of your withdrawal from this contract. Zeit für Brot will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund.

4. Terms of payment

4.1 The voucher prices are gross prices including VAT.

4.2 Payment of the price is due immediately after conclusion of the contract.

4.3 You can pay for your voucher by credit card, Apple Pay or Google Pay. There are no fees for you.

4.4 We will pass on the information provided during the ordering process, together with the information about the order (name, address, account number, bank code, credit card number if applicable, invoice amount, currency and transaction number) to the respective payment service provider, insofar as this is necessary for the purpose of payment processing. You can find more detailed information on this in our privacy policy, which is available on the Zeit-für-Brot website.

5. Delivery

The electronic gift voucher is usually delivered immediately after receipt of payment. The voucher is delivered by e-mail, which contains a QR code with the voucher and – at your request – as an Apple Wallet or Google Wallet document, allowing you to add the voucher to your Apple or Google Wallet. Unfortunately, it is not possible to collect vouchers in person.

6.    Redeeming a voucher and refunds

Unless expressly agreed otherwise, the following applies to the redemption and refund of vouchers:

(a) The voucher can only be redeemed once;

(b) The voucher can be redeemed by any person who presents it at a Brot-Bäckerei branch at any time;

(c) The voucher will not be accepted or processed by third parties. The voucher cannot be redeemed for cash. In particular, the voucher cannot be used for cash payments, transfers, the purchase of foreign currency or cryptocurrencies, or as a general means of payment.

(d) The voucher is valid for three years from the end of the year in which it is issued.

(e) The voucher must be presented at a bread bakery branch before the end of its period of validity. If it is not presented before the end of this period, it will automatically expire and can no longer be redeemed.

(f)  The voucher does not entitle you to receive specific goods or services or to receive the services at a specific time.

(g) If you redeem the voucher for less than the value stated on it, the value of the voucher will be reduced accordingly. You can then redeem the remaining amount until the end of the validity period.

(h) If you exercise your right of withdrawal in accordance with Section 3 of these General Terms and Conditions and have already redeemed the voucher in full or in part at the time of withdrawal, we will only refund you the difference that has not yet been redeemed. Furthermore, we are entitled to compensation for the value, which we will offset against your claim for repayment.

7. Loss of voucher

Zeit für Brot is not responsible for lost or stolen vouchers and is not obliged to block voucher codes if they are reported as lost. You are therefore not entitled to a refund of payments made in the event of loss or theft of a voucher.

8. Liability

8.1 Zeit für Brot shall be liable without limitation for damages resulting from injury to life, limb or health caused by intentional or negligent breach of duty by Zeit für Brot or its vicarious agents. Zeit für Brot shall also be liable without limitation for other damages resulting from intentional or grossly negligent breaches of duty by Zeit für Brot or its vicarious agents.

8.2 Zeit für Brot shall only be liable for property damage and financial loss resulting from a simple negligent breach of essential contractual obligations to the extent of the damage that was foreseeable at the time the respective contract was concluded and is typical for this type of contract; essential contractual obligations are those whose fulfilment characterises the contract and on which you may rely.

8.3 Otherwise, liability is excluded.

8.4 Insofar as Zeit für Brot's liability is limited or excluded, the limitations or exclusions also apply to the personal liability of Zeit für Brot's employees, legal representatives and vicarious agents.

8.5 The limitations and exclusions of liability pursuant to this Section 8 shall not affect Zeit für Brot's liability pursuant to the mandatory statutory provisions of the Product Liability Act, due to fraudulent concealment of a defect or the assumption of a guarantee for the quality of an item.

9.    Data protection

Zeit für Brot complies with the provisions of the General Data Protection Regulation (GDPR). For more information on how we process your personal data when you purchase a gift voucher via the ZfB website, please refer to our data protection information, which is available on the ZfB website.

10.    Place of jurisdiction and applicable law

10.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers who do not conclude the contract for professional or commercial purposes, this choice of law applies only insofar as the protection granted by mandatory provisions of the law of the country in which the consumer has their habitual residence is not withdrawn.

10.2 If the voucher purchaser is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from or in connection with this contract is Berlin. However, Zeit für Brot is entitled to sue the merchant at the court of his place of residence or business. The jurisdiction based on an exclusive place of jurisdiction remains unaffected by this.

11.    Other provisions

11.1 Should individual provisions of these terms and conditions be wholly or partially invalid or void, the remaining provisions shall remain unaffected.

11.2 We always endeavour to resolve any discrepancies in existing contracts by mutual agreement. In this context, we would like to point out that Zeit für Brot does not offer the option of participating in consumer arbitration proceedings in accordance with the Consumer Dispute Resolution Act (VSBG). Zeit für Brot is not legally obliged to do so.
